Art. 1 / Conclusion of contracts of sale

The confirmation and the sending of the order by the customer (for "Customer" we mean the user of the site isexyshop.com who accesses the e-commerce check out), according to the instructions that from time to time will appear on the web pages involves the taking vision and the integral acceptance of the present general conditions of sale by the Customer. The contract of sale between isexyshop.com and the Customer is concluded with the acceptance of the order by isexyshop.com.

If the customer is a consumer (a person who buys goods for purposes not related to his professional activity, or makes the purchase by requesting an invoice headed to a valid VAT number) once the online purchase procedure, will print or save an electronic copy and keep these general conditions of sale, in accordance with the provisions of Article 3 and 4 of D. Decree 185/99 on distance selling.

It is excluded any right of the customer to damages or compensation, as well as any contractual or extra-contractual liability for non-acceptance, even partial, of an order.

Art. 2 / How to purchase

The customer can only purchase products in the online catalog at the time the order is placed and viewable online at isexyshop.com as described in the relevant information sheets. The order will be validly processed at the time of receipt on the mailbox communicated by the customer of the confirmation of the authorization to charge the customer's credit card of the price and any costs for transport and delivery, as better provided for in art.5 below.

The image accompanying the description of a product may not be fully representative of its characteristics but differ in color, size, accessories in the picture. The correct receipt of the order is confirmed by isexyshop.com by means of an email reply, sent to the email address provided by the Customer. This confirmation message will report the date and time of receipt of the order and a Customer order number to be used in any further communication with isexyshop.com. The message will show all the data entered by the Customer, any information relating to the essential characteristics of the good, the indication of the price, methods of payment, delivery methods and costs and applicable taxes. The Customer will have to verify the correctness and communicate promptly any corrections, according to the modalities described in this document.

In the case of non-acceptance of the order, isexyshop.com ensures timely communication to the customer.

Art. 3 / Prices

The products will be sold at prices, inclusive of VAT, indicated in the product page online at the time of confirmation of the order by the customer. Delivery costs may be charged to the Customer and will eventually appear on the web page of the "order summary". Before the customer confirms the order by clicking on the appropriate button, on the web page will appear the summary of the prices of the products loaded on the cart and delivery costs. These data will then be automatically reproduced in the order form that the customer sends to isexyshop.com following the order confirmation procedures.

Art. 4 / Accounting documents and delivery methods

For each order accepted and carried out, isexyshop.com issue a fiscal receipt of the material shipped, sending it by e-mail to the holder of the order, pursuant to art 14 D.P.R. 445/2000. For the issuance of tax receipt are the information provided by the customer when ordering. No variation of the fiscal document will be possible, after the emission of the same one. No responsibility can be attributed to isexyshop.com in case of delay in the order or delivery of the order.

Art. 5 / Methods of payment

The customer can pay by credit card, Apple Pay, Amazon Pay, PayPal, Google Pay, Shop Pay, Shop Pay Installments or Bank Transfer.

Contextually to the order by the Customer, the bank of reference (in case of payment by credit card) will authorize and charge the amount related to the order on the Customer's credit card. In the event that the customer exercises the right of withdrawal, in the manner defined in Article 6 below, isexyshop.com return the amount previously charged directly to the method of payment used by the customer excluding shipping costs already incurred.

At no time during the purchase process isexyshop.com is able to know the information relating to the customer's credit card, transmitted via secure connection directly to the site of the bank handling the transaction and no computer archive of isexyshop.com will retain such data.

Art. 6 / Right of withdrawal

Pursuant to art. 5 DL 185/1999, if the customer is a consumer (ie a person who buys goods for purposes not related to his professional activity, or making the purchase by requesting an invoice headed to a valid VAT number), has the right to terminate the purchase contract for any reason, without explanation and without penalty, subject to compliance with the conditions set out herein. To exercise this right, the customer must send isexyshop.com a written notice to that effect, within 14 working days from the date of receipt of goods. This communication must be sent by e-mail to info@isexyshop.com. Once the above-mentioned communication of withdrawal has been received, the Customer Service of isexyshop.com will quickly communicate to the Customer the instructions on how to return the goods, which must be received by isexyshop.com within 4 days from the authorization.

The right of withdrawal is still subject to the following conditions:

The right of withdrawal falls totally, for lack of the essential integrity of the good (packaging and / or its contents), in cases where isexyshop.com ascertains

The absence of integral elements of the product (accessories, parts, ...).The damage of the product for reasons other than its transport.In case of forfeiture of the right of withdrawal, isexyshop.com will return to sender the property purchased by charging the same shipping costs.

The right of withdrawal is excluded, pursuant to Article 59 letter. c) and letter. e) D. Lgs. 206/2005 (Consumer Code), in the case of customized and personalized goods and sealed goods that are not suitable to be returned for hygienic reasons or related to the protection of health. Therefore, we will not refund products intended only to come into contact with intimate parts (such as sex toys or underwear), if the packaging containing the product appears to have been opened or the product used in any way, in order to protect the health and hygiene of our users. The breaking of the "seal of guarantee" or any damage to the package will therefore prevent the exercise of the right of withdrawal for these products.

Art. 7 /Warranty and complaints

The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect should not be covered by the manufacturer's conventional warranty, the customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as the costs of transportation, if incurred by isexyshop.com.

The guarantee of 24 months pursuant to Legislative Decree 206/05 applies to products that present a lack of conformity, provided that the product itself is used properly, in accordance with its intended use and as provided in the technical documentation attached. This warranty is reserved for the private consumer (a person who buys goods for purposes not related to his professional activity, or making a purchase without indicating in the order form a reference to VAT).

In case of lack of conformity, isexyshop.com provides, without cost to the customer, the restoration of conformity of the product by repair / replacement or reduction of the price, until the termination of the contract. If, following intervention by an Authorized Service Center, the defect should not be a lack of conformity pursuant to Legislative Decree 206/05, the customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as the costs of transport if incurred by isexyshop.com. Replacements in case of DOA (Dead On Arrival: product not working on delivery) occur only if expressly provided by the manufacturer. The timing of replacement or repair of the product depends exclusively on the policies of the manufacturer.

In the event that, for whatever reason, is unable to make its customer a product under warranty (restored or replaced), isexyshop.com will proceed at its own discretion to refund the amount paid taking into account the use of the good or its replacement with a product of equal or superior characteristics.

The timing of repair or replacement of the product depends exclusively on the policies of the manufacturer and no damage can be claimed to isexyshop.com for any delays in repairs or replacements.

In cases where the application of safeguards provides for the return of the product, the goods must be returned by the customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. ...); to limit damage to the original package, we recommend to insert it in a second box, should be avoided in all cases the attachment of labels or tape directly on the original packaging of the product.

This contract is governed by Italian law.
